§ 11-347. Penalty.

  • (a)

    Any person, firm or corporation violating the provisions of this article shall be guilty of a misdemeanor and shall be punishable pursuant to the provisions of G.S. 14-4, which provides for a maximum fine of up to $500.00.

    (b)

    Violation of this article subjects the offender to a civil penalty of $100.00 for a first offense, $300.00 for a second offense, and $500.00 for a third or subsequent offense to be recovered by the county in a civil action in the nature of debt if the offender does not pay the penalty within ten days after he has been cited for a violation of this chapter.

    (c)

    This article may be enforced by an appropriate equitable remedy issuing from a court of competent jurisdiction.

    (d)

    Pursuant to the authority granted in G.S. 153A-123, this article may be enforced by any one or more of the remedies specified in this section. Each day's continuing violation of this article is a separate and distinct offense.
