§ 44-41. Charges generally.

  • For the service of collecting and disposing of refuse, the owner or occupant of all premises from which refuse is collected by the county or its franchisee shall be charged such rates as may be established, from time to time, by the county commissioners. No owner or occupant of these premises shall be exempt from the collection and disposal service provided by the county or by individual franchisees.

    (1)

    Except as otherwise provided in this chapter, all owners or occupants of premises within the county shall be subject to the service charges prescribed by the county commissioners. Fees for the collection and disposal of refuse by the county and/or its franchisees shall be charged to the owner of all premises in the amount specified in the fee schedule located in Appendix B.

    (2)

    New Hanover County Government and New Hanover County Public Schools are exempt from tipping fees for the disposal of municipal solid waste at the New Hanover County solid waste disposal facilities.

    (3)

    The North Carolina Department of Transportation is exempt from tipping fees for the disposal of solid waste at the county solid waste facilities which is generated from litter pickup activities along public roads and highways in New Hanover County by Adopt-A-Highway volunteers, inmate litter crews, and/or highway maintenance personnel. This tipping fee exemption does not apply to the disposal of solid waste generated by any North Carolina Department of Transportation facilities, or any maintenance or construction activities.

    (4)

    The Director of Environmental Management may waive tipping fees to organized community cleanup activities for parks, green spaces, beaches, waterways, or similar public open spaces in New Hanover County.

    (5)

    Any federal Internal Revenue Code Section 501(c)(3) or 501(d) non-profit organization located in New Hanover County which accepts clothing, furniture or other items of personal property on a year-round basis, and sells those items of personal property to raise funds for the organization's services, or distributes those items of personal property to persons in need, shall be exempt from paying tipping fees on that personal property which is in such disrepair that it cannot be resold or distributed and must be transported and disposed of at the New Hanover County Solid Waste facilities.

    (6)

    All requests for exemption meeting criteria subsections 44-41(1)—(5) shall be made on the appropriate form, in writing, to the director of environmental management 30 days prior to the event. Applicants will be promptly notified of approval or disapproval of the request in writing.
